Consideration of Administrative Rule Amendments

The purpose of this memo is to inform you of some important administrative rule changes that the Department is considering based on feedback received at the 2016 PRI Summer and Fall Conferences. To maintain compliance with O.C.G.A 40-5-81(d), the following Driver Improvement and Risk Reduction rules are being contemplated:

➢ 375-5-1-.24 Gratuities

➢ 375-5-6-.32 Gratuities These new rules specify that the following items are prohibited from being offered by an owner, agent, representative, instructor, or employee to any student or prospective student: legal tender, meals including beverages, gift cards, transportation, products or services at a discounted price, or anything of monetary value not deemed to be a customer service exclusion. Customer service exclusions are limited to ink pens, water, coffee, candy, and Wi-Fi.

A first violation of these rules will result in an administrative fine of $300. A second or subsequent violation will result in a 30 day suspension. A violation of 40-5-81(d) is a crime punishable as a misdemeanor. Each person convicted of a second or subsequent offense shall have his or her certification revoked.
